Spark Media Automation Terms of Service

These Terms of Service (“Terms”) govern access to and use of Spark Media Automation (“Spark Media Automation”, “SMA”, “we”, “us”, or “our”), the social media operations platform available at http://localhost:3000. Spark Media Automation is developed and operated as a TechnSEO project. By signing in to or otherwise using Spark Media Automation, you agree to these Terms. If you do not agree, do not use the platform.
1. Eligibility and authorized use
SMA is a private administrative console intended for authorized personnel only. Access is granted by the organization operating this deployment. You must be at least 18 years old (or the age of legal majority in your jurisdiction) and have permission from that organization to use SMA.
You may use SMA only for legitimate business or organizational purposes related to managing connected social accounts, preparing content, and publishing on behalf of accounts you are authorized to manage.
2. Account responsibilities
You are responsible for:
- Maintaining the confidentiality of your login credentials and any two-factor authentication devices
- All activity that occurs under your account
- Ensuring that information you provide to SMA is accurate and kept up to date
- Promptly notifying the platform administrator if you suspect unauthorized access to your account
We may suspend or terminate access if we reasonably believe your account credentials have been compromised or your use violates these Terms.
3. Connected platforms and third-party services
SMA integrates with third-party platforms and services, including but not limited to Meta (Facebook, Instagram, Threads), Postiz, LinkedIn, and other networks supported by your deployment. Your use of those services through SMA is also subject to each platform's own terms, policies, and developer rules.
When you connect an account through OAuth or similar authorization flows, you represent that you have the authority to grant SMA the permissions requested and to publish content to the selected destinations. We store access tokens and related credentials in encrypted form as described in our Privacy Policy.
We do not control third-party platforms and are not responsible for their availability, API changes, rate limits, moderation decisions, or enforcement actions taken against connected accounts.
4. Acceptable use
You agree not to use SMA to:
- Violate applicable laws, regulations, or third-party platform policies
- Publish spam, malware, deceptive content, or material that infringes intellectual property or privacy rights
- Harass, threaten, or discriminate against others
- Attempt to gain unauthorized access to SMA, other users' accounts, or connected platform assets
- Reverse engineer, scrape, or probe the service except as expressly permitted by law
- Interfere with or disrupt the integrity, security, or performance of SMA or its infrastructure
- Share access credentials with unauthorized persons
We may investigate suspected violations and cooperate with platform providers or law enforcement where appropriate.
5. Content and intellectual property
You retain ownership of content you upload or submit through SMA, subject to the licenses you grant to third-party platforms when publishing. You grant us a limited license to host, process, transmit, and display that content solely to operate SMA and fulfill publishing requests you initiate.
SMA, its software, branding, documentation, and underlying technology are owned by TechnSEO and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the platform as authorized.
6. Service availability and changes
SMA is provided on an “as available” basis. We may modify, suspend, or discontinue features, integrations, or the entire service at any time, with or without notice, where reasonably necessary for maintenance, security, compliance, or product development.
Background jobs, scheduled publishing, and third-party API calls may fail or be delayed due to network conditions, platform outages, token expiry, or configuration errors. You are responsible for reviewing publishing results and retrying or correcting failed operations where appropriate.
7. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMA IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that SMA will be uninterrupted, error-free, secure, or that publishing to any destination will succeed. We do not provide legal, marketing, or compliance advice regarding your content or use of social platforms.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNSEO, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF SMA.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR SMA WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SMA IN THE TWELVE MONTHS BEFORE THE CLAIM, IF ANY, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations of liability; in those cases, the above limits apply to the fullest extent permitted by applicable law.
9. Indemnification
You agree to indemnify and hold harmless TechnSEO and the organization operating this SMA deployment from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of SMA, content you publish, connected accounts you manage without proper authorization, or your violation of these Terms or applicable law.
10. Termination
Your access may be revoked at any time by the administrator of this deployment or by us for violation of these Terms, security concerns, or discontinuation of the service.
Upon termination, your right to use SMA ceases immediately. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and governing law — will remain in effect.
11. Privacy
Our collection and use of information is described in the Privacy Policy. By using SMA, you acknowledge that policy.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of SMA after changes become effective constitutes acceptance of the updated Terms where permitted by law.
13. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles, except where mandatory local consumer or data-protection laws require otherwise.
